The Nigerian Trade Mark Regime and Challenges of Economic Development

Trade regulation is critical in the new economic order as national laws grapple with the challenges of global harmonization. This trend in global trade regulation and harmonization has opened up vistas in the areas of intellectual property, especially trade and allied marks. Hence, trademark protection occupies a center stage in the ensuing global trade dynamics. In this paper, we focus on the regulatory framework for Nigeria’s trade market regime in the light of the TRIPS Agreement and highlight trademark’s potential to advance that country’s new investment policies and technology transfer aspirations. We argue for a sub-regional harmonization of trademark regime within the existing Economic Community of West Africa States (ECOWAS) in which Nigeria plays a pivotal role.
